General Terms and Conditions (GTC)
§ 1 Scope, subject matter of the contract
1.1 These terms apply to the rental of apartments (hereinafter “apartment”) for accommodation purposes as well as to all further services provided by the operator in this context. They apply to both consumers and businesses; where a clause distinguishes between them, this is indicated.
1.2 The apartments serve exclusively for temporary accommodation, for a maximum of six months, unless otherwise agreed in text form.
1.3 There is no entitlement to a specific apartment within a category unless this has been expressly promised.
1.4 Subletting or further letting of the apartments provided, as well as any use for purposes other than accommodation, require the operator’s prior consent in text form.
§ 2 Conclusion of the contract
2.1 The accommodation contract is concluded upon confirmation of the booking by the operator. Booking and confirmation may be made by telephone, by e-mail, via the online booking system or in writing.
2.2 The contracting parties are the operator and the guest. If the person making the booking does so for additional guests, they are liable for those guests’ obligations under the contract as for their own.
§ 3 Services, prices, payment
3.1 The prices displayed in the booking system at the time of booking apply. They include the statutory value-added tax applicable in each case.
3.2 Payment is processed via the payment service provider Stripe.
3.3 For bookings made more than 7 days before the arrival date, the operator issues an invoice; the total amount is due no later than 7 days before arrival.
3.4 For bookings made within 7 days before the arrival date, the total amount is payable immediately upon booking via Stripe.
3.5 Payment is decisive for cancellability: before payment, cancellation is possible in accordance with § 4. After payment has been made, the booking is binding; the amount paid is non-refundable.
3.6 If the guest defaults on a payment that is due, the operator may terminate the contract with immediate effect and let the apartment to another party. The operator reserves the right to claim further damages, in particular for the loss of an alternative letting.
§ 4 Withdrawal, cancellation, no-show
4.1 As long as no payment has yet been made, the guest may cancel free of charge in text form (e.g. by e-mail) up to 7 days before arrival.
4.2 In the event of cancellation later than 7 days before arrival, as well as in the event of non-arrival without prior cancellation (no-show), the agreed total price becomes due as compensation (100 %), less saved expenses.
4.3 After payment has been made, cancellation is excluded; § 3.5 applies.
4.4 The operator is entitled to withdraw from the contract for good cause, in particular in cases of force majeure, in the event of incorrect or misleading information provided by the guest about their identity or the purpose of the booking, or if performance of the contract becomes impossible for reasons beyond the operator’s control. The guest will be informed without delay; amounts already paid will be refunded in such cases.
§ 5 Right of withdrawal
5.1 For contracts on accommodation for purposes other than residential use that are concluded for a specific date or period, there is no statutory right of withdrawal (Section 312g(2) no. 9 of the German Civil Code, BGB). Booking an apartment for a fixed stay period is therefore binding from the outset; the cancellation rules under § 4 apply.
§ 6 Arrival and departure
6.1 The apartment is available to the guest from 3:00 p.m. on the day of arrival. If the apartment is already ready for occupancy, earlier check-in is possible by arrangement.
6.2 On the day of departure, the apartment must be vacated by 11:00 a.m. If vacating takes place later for reasons attributable to the guest, 50 % of the daily rate will be charged; the operator reserves the right to claim further damages (e.g. due to a prevented re-letting).
6.3 Arrival before 12:00 noon or after 8:00 p.m. must be arranged with the operator in good time in advance.
§ 7 Guest obligations, house rules
7.1 All apartments are non-smoking apartments. Smoking is prohibited in the apartments and in the indoor areas. In the event of a breach, the costs of special cleaning may be charged.
7.2 The guest undertakes to treat the apartment with care and to behave considerately towards the neighbourhood (quiet courtyard location).
7.3 The maximum number of persons specified for each apartment must be observed.
7.4 Bringing pets into the apartments is not permitted.
§ 8 Liability, notification of defects
8.1 The guest is liable to the operator for damage caused by the guest or their visitors.
8.2 The operator accepts no liability for items brought along in the event of loss, theft, damage or destruction; any insurance is the guest’s responsibility.
8.3 If performance of the service becomes impossible due to force majeure, the operator is not liable; in such a case the operator will endeavour to procure an equivalent service.
8.4 Disruptions or defects must be reported to the operator without delay so that remedy can be arranged. The guest is obliged to contribute what is reasonable to remedy the disruption and to keep any damage to a minimum.
8.5 Items left behind are kept for 14 days and disposed of thereafter. Any return shipment is at the guest’s expense and risk.
8.6 In all other respects, the operator is liable without limitation in cases of intent and gross negligence, as well as for injury to life, body or health. In cases of simple negligence, the operator is liable only for the breach of essential contractual obligations (cardinal obligations) and limited in amount to the foreseeable damage typical for the contract.
§ 9 Data protection
The processing of personal data is governed by the operator’s privacy policy, which is available on the website.
§ 10 Final provisions
10.1 The place of performance, place of payment and — to the extent legally permissible — place of jurisdiction is the operator’s registered seat in Leverkusen.
10.2 The law of the Federal Republic of Germany applies.
10.3 Should individual provisions of these GTC be or become invalid or void, the validity of the remaining provisions shall not be affected thereby. In all other respects, the statutory provisions apply.
10.4 The German version of these GTC shall prevail. Translations into other languages serve solely to aid understanding; in the event of discrepancies or questions of interpretation, the German version takes precedence.
